Recommendation
Take the following actions:
1) RESCIND the action taken by the Baldwin County Commission during its September 1, 2020 Regular Meeting, more specifically, only the portion of the staff recommendation of Agenda item BA2, which authorized the placement of the Legislative Act No. 2015-420 annexing property within the corporate limits of the City of Spanish Fort into the minutes of the September 1, 2020, Baldwin County Commission regular meeting and authorized the County Commission to notify various departments/organizations regarding the same.
2) Notify the following departments/organizations:

BACKGROUND INFORMATION
Previous Commission action/date: September 1, 2020, Baldwin County Commission Regular Meeting. Commission made various Ordinances and Legislative Acts received from the City of Spanish Fort regarding annexation of property, part of the record. The Commission also forwarded the information to various departments/organizations as required.
Background: On December 22, 2020, Baldwin County Commission received correspondence from the City of Spanish Fort, regarding a number of annexations which had occurred in the City within the last few years. Included in that mailing as properties being annexed were those properties included in Local Legislative Act No. 2015-420. The bill called for an annexation election. The annexation election called for in Act No. 2015-420 was unsuccessful. As a result, the properties identified and included in the Act were in fact not annexed into the City of Spanish Fort. That bill was mistakenly included in the list of annexed properties sent by the City to the County.
At this time staff brings this item back to rescind the action taken on September 1, 2020, due to the Staff Recommendation authorizing the placement of the Legislative Act No. 2015-420, annexing property within the corporate limits of the City of Spanish Fort. The action before the Commission on January 19, 2021, will ensure the records reflect the properties contained in Act No. 2015-420 are not identified or reflected as lying within the corporate limits of the City of Spanish Fort.
