STAFF RECOMMENDATION
Recommendation
Approve a Reimbursable Utility Agreement between the Baldwin County Commission and Fairhope Utilities for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this relocation is $428,889.29 with the Alabama Department of Transportation (ALDOT) providing a 90% match of $386,000.36 and Baldwin County providing the remaining 10% at $42,888.93.
This agreement shall be effective upon full execution and will terminate upon completion of the project.

BACKGROUND INFORMATION
Background: The Highway Department has been awarded a grant under the HSIP for a proposed roundabout on County Road 13 and County Road 44. Under the HSIP program, utility relocation is a reimbursable phase of the project.
Previous Commission action/date:
May 17, 2022: 1) Approved a Reimbursable Utility Agreement between the Baldwin County Commission and Riviera Utilities for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this relocation is $137,278.26 with the Alabama Department of Transportation (ALDOT) providing a 90% match of $123,550.43 and Baldwin County providing the remaining 10% at $13,727.83 (This agreement shall be effective upon full execution and will terminate upon completion of the project.); and 2) Approved a Reimbursable Utility Agreement between the Baldwin County Commission and Baldwin EMC for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this relocation is $26,064.08 with the Alabama Department of Transportation (ALDOT) providing a 90% match of $23,457.67 and Baldwin County providing the remaining 10% at $ 2,606.41(This agreement shall be effective upon full execution and will terminate upon completion of the project.)
May 17, 2022:1) Approved a Non-Reimbursable Utility Agreement between the Baldwin County Commission and Alabama Power Company for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. (This agreement shall be effective upon full execution and will terminate upon completion of the project.); and 2) Approved a Non-Reimbursable Utility Agreement between the Baldwin County Commission and AT&T Communications for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. (This agreement shall be effective upon full execution and will terminate upon completion of the project.); and 3) Approved a Non-Reimbursable Utility Agreement between the Baldwin County Commission and Mediacom for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. (This agreement shall be effective upon full execution and will terminate upon completion of the project.)
April 5, 2022: Approved an extension to the Intergovernmental Service Agreement with the City of Fairhope for the construction of a roundabout at Twin Beach Road and County Road 13 extending the term of the agreement by thirty-six (36) months.
August 3, 2021: Approved Resolution # 2021-106 and authorized the Chairman to execute Supplemental Agreement No. 1 between the Baldwin County Commission and the Alabama Department of Transportation for the funding of preliminary engineering, right-of-way, utility relocation, construction, and construction engineering inspection for a roundabout at County Road 13 and County Road 44 (Twin Beech Road). (This agreement shall be effective upon full execution and shall be in effect until the project has been completed and reimbursements are complete. This agreement may be terminated by either party upon delivery of a thirty (30) day notice of termination.)
March 19, 2019: Approved Resolution # 2019-058 and authorized the Chairman to execute an agreement between the Baldwin County Commission and the Alabama Department of Transportation for the funding of Preliminary Engineering, Right-of-Way, Utility Relocation, Construction and Construction Engineering Inspection for a Roundabout at County Road 13 and County Road 44 (Twin Beech Road). (This agreement shall be effective upon full execution and shall be in effect until the project has been completed and reimbursements are complete. February 5, 2019: Approved an Intergovernmental Service Agreement with the City of Fairhope for the construction of a roundabout at Twin Beech Road and County Road 13.
August 21, 2018: Authorized the Highway Department to submit documentation and application for a grant under the Federal Highway Administration -Highway Safety Improvement Program (HSIP) for a proposed roundabout on County Road 13 at County Road 44; and authorize the Chairman to execute a letter of intent and ant other grant related documents as required.
