STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Approve the Agreement between the Baldwin County Commission and the State of Alabama relative to a Pass Through of Section 5307 Federal Funds for an Urbanized Area Public Transportation Project for the Eastern Shore Urbanized Area in Baldwin County; and
2) Adopt Resolution #2022-151 which authorizes the Baldwin County Commission to enter into an Agreement with the State of Alabama, acting by and through the Alabama Department of Transportation, relating to public transportation with partial funding by the Federal Transit Administration for Fiscal Year 2023; and
3) Authorize the Clerk / Treasurer to sign the Certification of Compliance with the Beason-Hammon Alabama Taxpayers and Citizen Protection Act.
(This agreement is effective on the date hereinafter stated as the date of approval by the Governor of Alabama and will terminate on September 30, 2023, or upon expenditure of all funds provided in the approved project funding, whichever occurs first. In addition, if the grant from the USDOT is terminated by USDOT, the State will have the right to terminate this Agreement by giving written notice of termination.)

BACKGROUND INFORMATION
Background: The Federal Transit Administration (FTA) Section 5307 Grant is approved annually. This grant secures Federal Funding to assist in supporting the capital and planning costs for an Urbanized Area Public Transportation Project for Baldwin Regional Area Transit System. This one (1) year formal agreement and the resolution are required in order for the Alabama Department of Transportation to begin the execution process for the pass through of the federal funding necessary for the Transit Passenger Shelters being constructed in Fairhope and Loxley in FY2023.
Previous Commission action/date: July 5, 2022 - BCC approved the Pass Through Agreement of Federal Funds for the 5311 Rural Transportation program.

Additional comments: The Pass Through agreement provided by ALDOT for the 5311 Rural Transit Program was submitted to Brad Hicks for review on June 17, 2022. This is the same document for the 5307 Urban Transportation Grant Program and was received from ALDOT on August 4, 2022.
