STAFF RECOMMENDATION

Recommendation

To accomplish the provisions set forth at Article 5 of the Baldwin County Flood Damage Prevention Ordinance, and in conformity to Section 11-19-19 of the Code of Alabama 1975, take the following actions related to the Baldwin County Flood Damage Prevention Ordinance Board of Adjustments:

1)  Re-appoint Mr. Mark Acreman as a regular member for a three (3) year term, said term commencing June 1, 2023, and expiring June 1, 2026; and

2)  Re-appoint Mr. Cliff Pitman as a regular member for a three (3) year term, said term commencing June 1, 2023, and expiring June 1, 2026; and

3)  Re-appoint Mr. Richard Peterson as a regular member for a three (3) year term, said term commencing June 1, 2023, and expiring June 1, 2026; and

4)  Re-appoint Mr. Timothy Barnhill as a regular member for a three (3) year term, said term commencing August 1, 2023, and expiring August 1, 2026; and

5)  Re-appoint Mr. Martin Pitts as a regular member for a three (3) year term, said term commencing August 1, 2023, and expiring August 1, 2026.

BACKGROUND INFORMATION

 

Background:  The Baldwin County Building Official nominates for re-appointment the respective persons listed in the staff recommendation and respectfully requests the Baldwin County Commission provide the required authorization for appointment. Further, the Baldwin County Building Official's office has confirmed that the persons referenced in the staff recommendation are residents of Baldwin County; therefore, staff confirms the foregoing persons are qualified to be appointed.

Section 11-19-3, et seq., Code of Alabama 1975, authorizes County Commissions of the State of Alabama to adopt zoning ordinances and building codes for flood-prone areas which lie outside the corporate limits of any municipality in the county.

 

Pursuant to the aforementioned statutory authority, the Baldwin County Commission adopted what is known as the Baldwin County Flood Damage Prevention Ordinance, which was last amended by the Baldwin County Commission during the April 16, 2019 regular meeting.

 

Since the Baldwin County Commission adopted the Baldwin County Flood Damage Prevention Ordinance pursuant to Section 11-19-3, et seq., Code of Alabama 1975, among other statutory authorities, Section 11-19-19, Code of Alabama 1975, requires County Commissions to provide for a "Board of Adjustment" to, in brief, in appropriate cases and subject to appropriate conditions and safeguards, make special exceptions to the terms of the zoning ordinance or regulations in harmony with its general purposes and interests and in accordance with general or specific rules adopted pursuant to Section 11-19-19, et seq., Code of Alabama 1975, (which in this case are the terms of the Baldwin County Flood Damage Prevention Ordinance which is authorized in part by Section 11-19-3, et seq., Code of Alabama 1975).

 

The Board consists of five (5) members who are residents of Baldwin County, Alabama, which are respectively appointed by the Baldwin County Commission for three (3) year terms.
