STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Approve terminating the Intergovernmental Service Agreement with the City of Daphne for construction of Corte Road Extension between County Road 13 and Friendship Road approved during the March 21, 2023, Baldwin County Regular Meeting (Agenda Item CN6); and
2) Notify the City of Daphne with thirty (30) days written notification of termination as stated in the agreement.

BACKGROUND INFORMATION
Background: The City of Daphne previously partnered with the County by committing $250,000.00 to construct an extension of Corte Road from County Road 13 to Friendship Road. After further discussion, it has been determined a Milton Jones Road extension is a more desirable east/west corridor to serve the traffic flow needs of the area. The current Intergovernmental Service Agreement must be terminated to allow the funds committed by the City of Daphne to be used on the new corridor.
The agreement may be terminated, with reasonable cause, upon written notice to the City. The County’s notice shall be deemed effective, and the Agreement terminated, thirty (30) days after the date notice is mailed by certified mail to the City.
Previous Commission action/date:
March 21, 2023 - The Commission approved an Intergovernmental Service Agreement between the Baldwin County Commission and the City of Daphne to construct an extension of Corte Road from County Road 13 to Friendship Road. The City of Daphne will assume responsibility for maintenance after the project is constructed. The Commission also adopted Resolution # 2023-085 authorizing annexation and transfer of responsibility for the extension of Corte Road and Friendship Road to the City of Daphne.
