STAFF RECOMMENDATION

Recommendation

As related to the Baldwin County Eastern Shore Health Care Authority, take the following actions:

 

1) Re-appoint Ms. Emalyn “Em” Johnson, for a six (6) year term, said term to commence April 30, 2024, and expire April 30, 2030; and

 

2) Re-appoint Mr. John Baker, for a six (6) year term, said term to commence April 30, 2024, and expire April 30, 2030; and

 

3) Re-appoint Mr. Marian E. “Tut” Wynne, for a six (6) year term, said term to commence April 30, 2024, and expire April 30, 2030.

BACKGROUND INFORMATION

 

Previous Commission action/date:  April 4, 2023 - Last BCC appointment to this board.

 

Background:  Baldwin County Eastern Shore Health Care Authority submitted correspondence to the Commission dated March 12, 2024 (attached), requesting the Commission to re-appoint three members to its Board of Directors. 

 

A copy of the Authority's certified resolution is required to be submitted within statutorily set time parameters and in resolution/certified form, to the Commission pursuant to §22-21-352, Code of Alabama 1975, which is found within "The Health Care Authorities Act of 1982" [codified collectively at §22-21-310, et seq., Code of Alabama 1975].

 

There are no "required qualifications" set forth in the Code section for citizens to be appointed to the Authority, however, within §22-21-316, Code of Alabama 1975, such "required qualifications" are self-imposed by the Authority through its Certificate of Reincorporation, as amended by the Authority on December 17, 2001, which requires that members be "residents of Baldwin County, Alabama."

 

Staff has verified the nominees meet the eligibility requirement of being residents of Baldwin County, Alabama.
